Foreign Office, November 14, 1908. PLEASE refer to your telegram No. 174 of the 8th instant relative to Shanghae-Ningpo Railway.

Counsel have advised bank that they do not participate in Agreement, and that payment of orders drawn according to Loan Contract, Article 14, cannot be refused.

To prevent bank from parting with the funds an injunction might possibly be obtained by the British and Chinese Corporation, who are a party to the Agreement.

That the Courts would agree to this step is, however, very doubtful.
